On June 14, 2016 the Office of Federal Contract Compliance Programs (OFCCP) issued their Final Rule for revised Sex Discrimination Guidelines, the first update in 45 years. The Department of Labor states, “OFCCP brings guidelines from the ‘Mad Men’ era to the modern era.” These new guidelines will become effective August 15, 2016 for all federal contractors and sub-contractors.
Organizations subject to these new guidelines include:
- Contractors that provide goods and services to a federal agency
- Any organization that has a single federal contract
- Organizations sub-contracted or federally assisted by a sum greater than $10,000
- An organization with federal contracts or subcontracts that exceed $10,000 in any 12-month period
The final rule includes updates to the Pregnancy Discrimination act of 1978 (PDA), rules to prevent gender-based pay discrimination, as well as protection from discrimination on the basis of gender identity and stereotyping.
